The 3 Types of Real Estate Records in Judea and Samaria: Information for land buyers, developers and investors in Israel
Now that we’ve explored the land ownership and control history of the area, it’s important to understand that to this very day, the Israeli government has allowed the territories of Judea and Samaria to remain in a state of military rule in effort to avoid international pressure via official annexation. This affects many matters concerning land records in Judea and Samaria.

Currently, there are several types of real estate records there:

  1. Bar Reshut – most settlements in Judea and Samaria still register housing units through this system. In essence, it means that the person or people who live(s) on the lot in question is/are not considered to own the land at all, but was/were only given permission to live there or build a house there.
  2. Lease (chakirah) – this is used in areas of high national consensus, meaning a low chance of eviction. They were “raised a rank” in registration, and in fact have long-term lease agreements with the local district military rule, similar to Tabu.
  3. Tabu Ownership (Jordanian) – this is the highest registered rank that exists in the region. Full registration of land ownership creates a high legal security on the one hand, and a compensatory legal implication (in case of eviction, G-d forbid) on the other hand.Keep in mind: The State of Israel makes it very difficult for Jews to directly purchase such land, and there are many fake deals advertising such transactions. It is therefore critical to work with companies that have proven experience with Tabu.
